  • Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Response to Alleged Infringement

Upon receiving a proper notice of alleged infringement, All Nebraska Forms will take whatever action it deems appropriate within its sole discretion, including the removal of the questioned content from the website. We will also make a good faith attempt to contact the party who submitted the content through the information provided at the time the content was submitted to our site.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may send us a counter-notification. Your counter-notification must be in writing and include the following:

  • Your physical or electronic signature.
  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

After receiving a counter-notification containing the information outlined above, All Nebraska Forms will promptly provide the person who provided the initial notification of claimed infringement with a copy of the counter-notification, and inform that person that the removed content may be replaced, or access to it restored, in 10 business days or more. Afterward, it is within our discretion to replace the removed content or re-enable access to it.
