The Nebraska Department of Roads Form R-123, known as the "Contractor's Statement of Experience, Equipment and Financial Condition," provides a standardized method for contractors to present their qualifications for road construction projects. Dated May 2005 and accessible via the Contract Lettings’ website, this essential document must be submitted to the department's Contract Lettings Section by a specified deadline to be considered for bidding. It is a critical step for contractors aiming to participate in the bidding process for the improvement, maintenance, or repair of Nebraska's roads and bridges, ensuring that only qualified bids are received and considered.
In the dynamic landscape of Nebraska's infrastructure development, the Department of Roads plays a pivotal role, particularly through its comprehensive process for contractor prequalification and bid submission. The department's Form R-123, "Contractor's Statement of Experience, Equipment, and Financial Condition," dated May 2005, stands as a crucial initial step for contractors aiming to participate in state projects. This form, available on the Contract Lettings' website, is a fundamental requirement for contractors before they can bid on construction, reconstruction, improvement, maintenance, or repair of state highways and bridges. Prequalification statements, as mandated, must be submitted to the Contract Lettings Section prior to a specified deadline, ensuring that only financially sound and experienced contractors are considered. This meticulous process is outlined within the broader context of the State of Nebraska's legislative framework, which governs contract lettings and prequalifications through a series of statutes. These statutes not only dictate the procedure for letting contracts to the lowest responsible bidder but also underscore the importance of maintaining high standards for labor wages and ensuring contractors meet stringent financial and performance criteria. Moreover, the department's regulations elucidate the qualifications necessary for contractors, including financial stability and the sufficiency of equipment, to undertake projects of various scales and complexities. Through these regulations, the Nebraska Department of Roads ensures that the state's infrastructure projects are executed efficiently, safely, and to the highest standards, reflecting a well-structured approach to managing public works.
The Department's Form R-123, "Contractor's Statement of Experience, Equipment and Financial Condition" dated May 2005 is available on the Contract Lettings’ website.

Pertinent Sections of the States Relating to
Letting of Contracts and Prequalifications of Bidders
Section 39-1348. Before letting contracts for the construction, reconstruction, improvement, maintenance, or repair of roads, bridges, and their appurtenances, the department shall advertise for sealed bids for not less than twenty days by publication of a notice thereof once a week three consecutive weeks in the official county newspaper designated by the county board in the county where the work is to be done, and in such additional newspaper or newspapers as may appear necessary to the department in order to give notice of the receiving of bids. Such advertisement shall state the place where the plans and specifications for the work may be inspected and shall designate the time when the bids shall be filed and opened; provided, that if through no fault of the department, publication of such notice fails to appear in any newspaper or newspapers in the manner hereinbefore provided, the department shall be deemed to have fulfilled the requirements of this section.
Section 39-1349. Construction contracts; letting; procedure; interest on retained payments; predetermined minimum wages. (1) Except as provided in subsection (3) of this section, all contracts for the construction, reconstruction, improvement, maintenance, or repair of state highway system roads and bridges and their appurtenances shall be let by the department to the lowest responsible bidder who has been qualified by the department. The department may reject any or all bids and cause the work to be done as may be directed by the department. If the contractor has furnished the department all required records and reports, the department shall pay to the contractor interest at a rate three percentage points above the average annual Federal Reserve composite prime lending rate for the previous calendar year rounded to the nearest one-tenth of one percent on the
amount retained and on the final payment due the contractor beginning sixty days after the work under the contract has been completed as evidenced by the completion date established in the department’s letter of tentative acceptance or, when tentative
acceptance has not been issued, beginning sixty days after completion of the work and running until the date when payment is tendered to the contractor.
(2)When the department is required by acts of Congress and rules and regulations made by an agent of the United States in pursuance of such acts to predetermine minimum wages to be paid laborers and mechanics employed on highway construction, the Director-State Engineer shall cause minimum rates of wages for such laborers and mechanics to be predetermined and set forth in contracts for such construction. The minimum rates shall be the scale of wages which the Director-State Engineer finds are paid and maintained by at least fifty percent of the contractors in performing highway work contracted with the department unless the Director-State Engineer further finds that such scale of wages so determined would unnecessarily increase the cost of such highway work to the state, in which event he or she shall reduce such determination to such scale of wages as he or she finds is required to avoid such unnecessary increase in the cost of such highway work.
(3)The department, in its sole discretion may permit a city or county to let state or federally funded contracts for the construction, reconstruction, improvement, maintenance, or repair of state highways, bridges, and their appurtenances located within the jurisdictional boundaries of such city or county, to the lowest responsible bidder prequalified to bid by the department when the work to be let is primarily local in nature and the department determines that it is in the public interest that the contract be let by the city or the county.
Section 39-1350. The department shall have the authority to act for any political or governmental subdivision or public corporation of this state for the purpose of taking bids or letting contracts for the construction, reconstruction, improvement, maintenance, or repair of roads, bridges, and their appurtenances. The department, while so acting, may take such bids and let such contracts at the offices of the Department of Roads, Lincoln, Nebraska; provided, that the department has the written consent of the political or governmental subdivision or public corporation where the work is to be done.
Section 39-1351. Any person desiring to submit to the department a bid for the performance of any contract for the construction, reconstruction, improvement, maintenance, or repair of roads, bridges, and their appurtenances, which the department proposes to let, shall apply to the department for prequalification not later than ten days before the letting of the contract. The department shall determine the extent of any applicants qualifications by a full and appropriate evaluation of his experience, equipment, financial resources, and performance record. In determining the qualification of persons to bid on any particular contract, the department shall consider the equipment and resources available for the particular contract contemplated; provided, that the above requirements shall not apply to contracts for repair and maintenance when the estimate of the engineer for such repair and maintenance is less than twenty-five hundred dollars, or of an emergency nature.
Section 39-1352. Any person, proposing to bid on a contract for the construction, reconstruction, improvement, maintenance, or repair of roads, bridges, and their appurtenances to be let by the department, shall submit to the department, at such times as it may require a statement showing his qualifications. Such statement shall be under oath and on a standard form to be prepared and supplied by the department. The financial showing required in the statement shall be certified by a certified public accountant or by a public accountant holding a currently valid permit from the Nebraska State Board of Public Accountancy. The statement shall be confidential and only for the use of the department.
Section 39-1353. This current qualification shall be the "current rating" which determines the amount of work for which any person is qualified at the particular letting and for which he or she may be awarded a contract or contracts, except that the department may use a tolerance of not more than twenty-five percent of a bidder's current rating and award him or her a contract or contracts in a total amount which does not exceed by more than twenty-five percent the current rating which is established by the department.
- PROPOSAL FORMS -
1.Proposal forms, for which prequalification of bidders is required, will be issued only to those qualified to bid on each contract. SPECIFIC INSTRUCTIONS - CONTRACTOR'S BALANCE SHEET AND SCHEDULES
(Pages 6 through 13)
(Where there are no instructions for a particular schedule, it is presumed that the schedule itself is self- explanatory.)

Where schedules are not complete in themselves, attach supplementary memoranda explaining fully.
INVESTMENTS (Schedule 1) - Where there is no quoted market price of securities of affiliated organizations and investments in partnerships, joint ventures, etc., the investment should be shown at cost, with an indication of the book value of the underlying net assets. Cost of investment should reflect initial cost adjusted for additional investment and subsequent profits, losses and distributions.

Filling out the Nebraska Department of Roads Form R-123, also known as the "Contractor's Statement of Experience, Equipment, and Financial Condition," is a critical step for contractors planning to bid on construction, reconstruction, improvement, maintenance, or repair of roads, bridges, and their appurtenances. This form must be submitted well ahead of the bid letting date to ensure the contractor's eligibility. Careful attention to detail and accurate representation of your qualifications are essential in this process.
Once the Nebraska Department of Roads has received and processed your Form R-123, you will be considered for prequalification based on your stated experience, equipment availability, and financial condition. If prequalified, you will be eligible to bid on contracts for the construction, reconstruction, improvement, maintenance, or repair of roads, bridges, and related structures. Keep in mind, staying updated with the department's letting schedule and any changes in requirements is crucial for maintaining your eligibility to bid on future projects.
Form R-123, known as the "Contractor's Statement of Experience, Equipment, and Financial Condition," is a document designed for contractors planning to bid on projects. Issued in May 2005, it's available on the Nebraska Department of Roads' Contract Lettings website. This form helps the department assess a contractor's capability and resources for undertaking road construction projects.
Prequalification statements must be delivered to the Contract Lettings Section of the Nebraska Department of Roads no later than 5:00 PM, at least ten (10) days before the letting date you intend to submit bids for. Ensure you check the letting schedule posted on the department's website to align your submission accordingly.
If you have any inquiries, you should reach out to the Nebraska Department of Roads Contract Lettings Section. They are available via mail at P.O. Box 94759, Lincoln, NE 68509-4759, by phone at (402) 479-4525, via fax at (402) 479-3803, or by email at NDOR_Contract_Lettings@dor.state.ne.us.
The Nebraska Department of Roads adheres to specific statutes for the letting of contracts concerning the construction, reconstruction, improvement, maintenance, or repair of state roads and bridges. Notices must be published for not less than three consecutive weeks in the county's official newspaper and possibly in additional newspapers to ensure adequate bid notice. Furthermore, contracts are awarded based on a competitive bidding process to prequalified, responsible bidders offering the lowest bids.
Contractors are required to submit a detailed account of their experience, equipment, financial status, and performance record for prequalification review at least 10 days before the contract letting date. This information is evaluated to determine the contractor's ability to undertake specific contracts successfully. The evaluation looks at financial stability, availability of appropriate equipment, organizational structure, and past performance.
The prequalification statement must include, under oath, a comprehensive account of the contractor's financial standing, equipment, organization, and past experience relevant to the type of work they intend to bid on. Financial details must be certified by a certified public accountant or a public accountant with a current permit from the Nebraska State Board of Public Accountancy. This statement is confidential and solely for departmental use.
Yes, the Nebraska Department of Roads may adjust a contractor's qualification rating if there are significant shifts in the contractor's financial ability, equipment availability, or other factors affecting their capability to perform the contracted work. Contractors seeking to change their rating or who have changes in their qualification status must submit a new statement or written request at least ten days before the letting in which they intend to bid.
Filling out governmental forms accurately is crucial, especially when dealing with detailed documentation required for something as significant as a Department of Roads contract in Nebraska. Common mistakes can set back or disqualify applicants. Understanding these pitfalls can significantly enhance one’s chances of submitting a successful application.
One prevalent mistake involves the submission timeline. Applicants often miss the vital stipulation that prequalification statements must be received by the Contract Lettings Section of the Nebraska Department of Roads prior to 5:00 p.m. at least ten (10) days before the letting in which the applicant intends to submit bids. This oversight can automatically disqualify an otherwise well-prepared submission.
Another frequent error relates to the financial documentation required. Prospective bidders sometimes fail to provide financial statements certified by a certified public accountant or a public accountant holding a currently valid permit from the Nebraska State Board of Public Accountancy. According to the registration specifications, the financial showing in the statement must be certified to meet the form's requirements. This misstep not only questions the credibility of the provided financial data but also indicates non-compliance with the Department’s directives.
Besides these errors, failure to comply with the rules about the confidentiality of the statements and proposals forms is also notable. The rules explicitly state that all information furnished to the department is confidential and that proposal forms, which are crucial in the prequalification process, will not be issued to any bidder later than 5:00 P.M. of the day preceding the letting, emphasizing the importance of both the confidentiality and the timeliness of submissions.
To navigate the complexity of the Nebraska Department of Roads form successfully, prospective contractors should approach the process meticulously, mindful of the finesse required in meeting the department's detailed submission criteria. By avoiding these common errors, applicants stand a much better chance of their prequalification statements being accepted, allowing them to bid on significant state highway projects.
Understanding the forms and documents typically required alongside the Nebraska Department of Roads form is crucial for entities interested in participating in the bidding process for construction projects managed by this department. Given the complexity and the need for meticulous adherence to procedures, here is a helpful guide of additional documents often used alongside the Department's Form R-123, "Contractor's Statement of Experience, Equipment and Financial Condition."
Being thorough and detailed in preparing and submitting these documents can significantly affect the bidding process's outcome. It's not just about meeting the bare minimum requirements but about presenting your business as the most qualified, reliable, and suitable for the project’s needs. Each document plays a vital role in showcasing your capabilities and commitment to fulfilling the contract’s obligations with the highest standards. Therefore, taking the time to carefully prepare and review each one before submission is well worth the effort.
The Nebraska Department of Roads Form R-123, "Contractor's Statement of Experience, Equipment and Financial Condition," shares similarities with other documents used in the construction and bidding sectors, specifically regarding the structure and the type of information requested. These similarities ensure a standardized process for evaluating contractors' qualifications across various projects and agencies. Below are descriptions of documents that share similarities with Form R-123:
Federal Contractor Qualification Statement (Standard Form 330): Similar to the Nebraska Department of Roads' Form R-123, the Federal Contractor Qualification Statement, or Standard Form 330, is a comprehensive document utilized by federal agencies to evaluate the qualifications of architectural and engineering firms interested in federal projects. Both documents require detailed information about the contractor's or firm's experience, capabilities, and financial stability. They also include sections for listing past projects, references, and key personnel, ensuring that agencies can assess the suitability of contractors or firms for specific projects based on their track record and resources.
State Department of Transportation (DOT) Prequalification Forms: Across the United States, various State Departments of Transportation employ prequalification forms for contractors wishing to bid on state-funded transportation projects. These forms, like Nebraska's Form R-123, aim to vet contractors' qualifications, financial stability, and capability to complete projects efficiently and successfully. While each state may have unique requirements, the core purpose aligns closely with Form R-123, asking for detailed information on experience, equipment, financial condition, and sometimes specific classifications of work the contractor is interested in or capable of performing.
Construction Manager at Risk (CMAR) Prequalification Forms: Construction Manager at Risk (CMAR) projects, which involve a commitment by the construction manager to deliver the project within a Guaranteed Maximum Price (GMP), also use prequalification forms that bear similarities to Form R-123. These documents collect extensive data on a construction firm's financial health, experience, management practices, and previous projects to assess whether they can meet the unique demands of a CMAR contract. The need to demonstrate a solid record of managing projects efficiently and within budget makes these forms especially akin to the information and assurances sought by the Nebraska Department of Roads through Form R-123.
When interacting with the Nebraska Department of Roads form, particularly the Contractor's Statement of Experience, Equipment, and Financial Condition (Form R-123), applicants need to follow specific guidelines to ensure their submissions are accepted and properly evaluated. Below are recommended practices for what to do and what not to do during this critical process.
